Deemed Contracts – Information for Non-Domestic Customers

What Is a Deemed Contract?

 

A Deemed Contract arises automatically where electricity is supplied to premises and:

  • No formal electricity supply contract has been agreed; and
  • Electricity is being consumed at the premises.

This typically occurs where:

  • A new occupier moves into premises without agreeing a contract;
  • A previous contract has ended and no new contract has been signed; or
  • We are directed to supply premises under industry arrangements.

A Deemed Contract ensures that electricity supply can continue while formal arrangements are put in place.

 

Principal Terms of Our Deemed Contract

If you are supplied under a Deemed Contract, the following principal terms apply:

  1. Charges

You will be charged at our applicable deemed tariff rates.

Deemed rates are variable plus 2p/kWh Management charge and may change from time to time. They are generally higher than fixed-term contract rates.

  1. Duration

The Deemed Contract continues until:

  • You enter into a formal supply contract with us;
  • You switch to another licensed electricity supplier; or
  • Supply is otherwise lawfully terminated.

The Deemed Contract will terminate automatically if a Last Resort Supply Direction is given to another supplier in respect of your premises.

  1. Payment

Bills will be issued based on:

  • Actual meter readings;
  • Customer-provided readings that we reasonably consider accurate; or
  • Estimated readings where no actual reading is available.

Bills are payable in accordance with our Terms and Conditions.

  1. Meter Access

You must allow safe and reasonable access to the meter for:

  • Reading;
  • Inspection;
  • Repair or replacement; or
  • Disconnection or reconnection where permitted.
  1. Termination

You may end the Deemed Contract at any time by:

  • Entering into a formal contract with us; or
  • Switching to another supplier.

You remain responsible for charges incurred up to the date supply transfers or ends.

Alternative Contracts May Be Available

Contracts with different terms and conditions may be available from 3T Power.

These may include:

  • Fixed-term contracts;
  • Variable contracts;
  • Tariffs tailored to your usage profile.

Our Deemed Contract Scheme

We have established a Deemed Contract Scheme in accordance with paragraph 3 of Schedule 6 to the Electricity (Northern Ireland) Order 1992 and Licence Condition 28.

Moving Into a Premises Supplied by 3T Power?

If you have recently moved into premises and are consuming electricity supplied by 3T Power, please contact us as soon as possible to:

  • Confirm your details;
  • Provide a meter reading; and
  • Agree a suitable supply contract.

This will help ensure you are on the most appropriate tariff for your business.
